By Barbara Ann Kelley,

SANFORD, Fla. (CBS Tampa) – Jeff Ashton, former prosecutor in the Casey Anthony murder trail, says he will defend his son in a drunk-driving case while he runs for State Attorney.

Alexander Ashton was pulled over in October of 2011 by a Seminole County sheriff’s deputy for speeding. The arrest reports states, “a Seminole County deputy pulled over the 21-year-old over because he was going 68 mph in a 45-mph zone.”  The report also says that when Deputies smelled alcohol on him he was given a breathalyzer test which he failed and then booked on DUI charges.

Deputies say Ashton blew twice the legal limit. Jeff Ashton acting as his son’s attorney got the results of the breathalyzer thrown out because the device is considered unreliable.

The 21-year-old Ashton is out on a $500 bond. He is charged with a second-degree misdemeanor charge of driving under the influence.

Ashton’s trail by jury is set for Thursday with his father Jeff Ashton acting his as attorney.

He faces up to two months in jail and a fine.
